Terms of Service

These Terms of Service ("Terms") govern your access to and use of DataLayer's APIs, data products, and related services ("Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Account & API Access

To use our APIs, you must create an account and obtain API credentials. You are responsible for maintaining the confidentiality of your API keys and for all activity that occurs under your account.

You must provide accurate and complete registration information. You must be at least 18 years old or have the legal authority to bind the entity you represent.

2. Acceptable Use

You agree not to:

  • Exceed your plan's rate limits or credit allocation without authorization
  • Redistribute, resell, or sublicense raw API data without written permission
  • Attempt to reverse-engineer, decompile, or access the source code of our APIs
  • Use the Services for any illegal purpose or in violation of applicable laws
  • Interfere with or disrupt the integrity or performance of the Services
  • Use automated tools to scrape or overload our infrastructure
  • Share API keys with unauthorized third parties

3. Data & Intellectual Property

DataLayer retains all ownership rights in the Services, APIs, documentation, and underlying data structures. Data delivered through our APIs is licensed, not sold.

You may use API data within your products and applications for internal business purposes and to serve your end users. You may not create a competing data service using our data without prior written consent.

4. Service Level & Availability

We aim to maintain 99.9% API uptime. However, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance windows will be communicated in advance when possible.

We reserve the right to modify, suspend, or discontinue any part of the Services with reasonable notice. For enterprise clients with SLAs, specific terms will be outlined in your service agreement.

5. Pricing & Credits

API usage is billed based on your plan's credit allocation. Credits consumed are non-refundable. Cached API responses do not consume credits. Pricing is subject to change with 30 days' notice.

6. Limitation of Liability

To the maximum extent permitted by law, DataLayer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services.

Our total liability for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

7. Indemnification

You agree to indemnify and hold harmless DataLayer, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

8. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your API keys will be revoked and you must cease all use of the Services.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Karachi, Pakistan.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered users. Continued use of the Services after changes constitutes acceptance of the updated Terms.
